Ernie Watts Quartet Contract Rider
This rider is part and parcel to the attached contract dated __________between ERNIE WATTS (herein after referred to as “Artist”) and ______ (herein after referred to as “Purchaser”). All provisions contained herein are part of one and the same contract. Purchaser warrants that it has the right to enter into this contract and is of legal age.
Purchaser agrees to supply at Purchaser’s sole cost and expense and adhere to the following requirements of Artist:
1. BILLING, ADVERTISING AND PUBLICITY:
A. Artist shall receive one hundred percent (100%) headline or Special Guest billing, whichever is applicable, in all advertising, lights, displays, programs, etc. Billing, advertising and publicity is to read in bold block lettering:

B. Copies of all printed advertising, previews and reviews should be mailed to Artist’s management.*
2. EQUIPMENT AND SECURITY:
A. LIGHTS: Use of lights should be kept to a minimum, however at no time should the stage be completely dark.
B. SOUND: A first class sound system suitable to the facility with working monitor system to include at least five monitors -- and monitor mixing board, along with a minimum of ten (10) professional type microphones with at least one straight stand and one boom stand. Microphones shall consist of one vocal, three amplifier, two piano (unless helper is used) and three drum (overhead, kick and snare). Artist provides a clip-on Shure Condenser Mic #98 H/C Phantom Power, which requires one XLR line-in connection. A straight mic stand for the vocal mic must also be provided by Purchaser. See stage set-up for placement.
C. PIANO: One acoustic piano (preferably Baby Grand) tuned to A-440 on the day of the performance and kept in tune throughout duration of the engagement, together with a comfortable, padded full-size piano bench. Electric substitute must be approved by Artist.
D. Four quality music stands shall be available on stage, to be provided by Purchaser.
E. LOAD IN/LOAD OUT - SOUND CHECK: Artist requires approximately one hour for load-in and set-up and approximately 45 minutes for load out. Sound check time shall be allotted subject to Artist’s travel schedule. Purchaser or Purchaser’s representative agrees to be present and available for consultation from the load-in through load-out of engagement, and shall provide qualified stage hands to assist in moving and set-up of Artists’ equipment.
3. DRESSING ROOM: Artist requires a clean, well-lighted, air conditioned and heated dressing room with hot and cold running water, toilet facilities, ten large cloth towels and at least one 110 volt a/c power outlet. A security person to guard Artist’s property shall be provided if no key to lock dressing room is available. No one except working personnel, performers and authorized guests are permitted backstage or in the dressing room. All guests to have dressing room access must be cleared through Artist’s party. A fresh vegetable and fruit platter for eight persons along with a selection of coffee/tea, cream, sugar, honey, cold spring water and juices shall be provided one hour prior to performance. A hot meal for five persons is to be provided following soundcheck, menu for which must be approved in advance with Artist or Artist’s representative.
4. RECORDING: Purchaser shall allow absolutely no recording or broadcast of Artist’s performance without prior written approval from Artist’s management. Purchaser shall not commit Artist to any personal appearances, interviews or any other type of promotion without prior consent from Artist’s management.
5. PARKING: Purchaser will provide up to four (4) parking spaces convenient to stage entrance for the exclusive use of Artist’s vehicles.
6. SPONSORSHIP: Purchaser agrees that there shall be no signs, placards, banners or other advertising materials on or near the stage during the entire performance, nor shall Artist’s appearance be sponsored by or in any manner be tied in with any commercial product and/or company, without Artist’s prior approval.
7. COMPLIMENTARY TICKETS: Purchaser agrees to make available at no charge to Artist up to ten (10) of the best seats in the house for Artist’s guests. Purchaser will be contacted by Artist’s management on or before the day of performance with a final number required, the balance of which, if any may be placed on sale.
8. Except as outlined in the prior paragraph, there shall be no complimentary or discount admissions except a maximum of twenty-five (25) tickets (or 1% of house seating, whichever is greater) which may be distributed by Purchaser for promotion.
9. MERCHANDISE: Artist shall have the sole and exclusive right, but not the obligation, to sell souvenir merchandise carrying Artist’s name, (i.e. T-shirts, jackets, etc.) including compact discs in connection with and at the performance hereunder and the receipts thereof shall belong exclusively to Artist.
10. HOTEL: If hotel is provided by Purchaser artist requires first class accommodations with in-house or attached restaurant with room service. Any hotel lacking such accommodations must be approved in advance by Artist’s management.
11. TRANSPORTATION (Initial applicable paragraph)
X_____ A - WHEN ERNIE WATTS FLIES: Purchaser agrees to supply at Purchaser’s sole cost and expense, one fully licensed, fully insured late model automobile with driver to pick up Artist at the airport and transport Artist to hotel and to all scheduled activities and from the hotel to the airport on the day following the engagement. Transportation is subject to Artist’s travel schedule.
______B - WHEN ENTIRE BAND FLIES: Purchaser agrees to supply at Purchaser’s sole expense, one fully licensed, fully insured late model automobile with driver and one van, or nine passenger station wagon for band’s equipment and luggage, to pick up Artist’s party at the airport and transport to hotel; from hotel to engagement, from engagement to hotel and to the airport as Artist’s schedule may dictate.
______C - WHEN ENTIRE BAND MOTORS: No transportation assistance will be required.
EXCESS BAGGAGE CHARGES: When contract includes roundtrip airline transportation, Purchaser shall also be responsible for cost of transporting Artist’s musical gear. Artist travels with a roadcase for saxophones and upright bass in coffin case. Due to airline rules and regulations, an excess baggage fee may be incurred when Artist travels with oversize cases. Purchaser agrees to reimburse Artist for excess baggage expenses upon presentation of airline receipt, for roundtrip expense related to transportation of musical gear.
12. FORCE MAJURE: If any member of Artist’s party shall become ill or incapacitated or if Artist shall be unable for any reason outside his control to attend the engagement, Artist shall not be required to perform, in which instance, any monies paid by Purchaser shall be returned and neither party to this agreement shall be under any further obligation to each other. In the event of civil disorder the likes of which could result in damage to life or property, Artist in his sole judgment shall have the right to terminate this agreement at any time without liability.
13. PERMITS AND VISAS: Purchaser agrees to petition, arrange and pay for the costs for alien employment certification with temporary work visas and proper documentation including if necessary, security deposits regarding the musical instruments and other equipment of the Artist and Artist's party. All immigration, entry fees and work permit/visa costs to be paid by Purchaser.
14. PAYMENTS: A. All payments (guarantees and overages) shall be made to Artist or designated representative prior to performance. Artist shall be provided with a complete sales accounting at closing of box office. ALL REST OF PAYMENTS TO ARTIST ARE TO BE MADE IN CASH in the currency noted on the contract. There shall be no tax deductions or reductions of any kind from the fee specified on the contract.
